DMCA Takedown Notices
If you believe that material hosted on or through our Services infringes your copyright, you may send a written notice to our designated agent that includes:
- Your physical or electronic signature, or the signature of a person authorized to act on behalf of the copyright owner.
- Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are involved.
- Identification of the material claimed to be infringing and information reasonably sufficient for us to locate it.
- Your contact information, including your name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.
Upon receipt of a valid DMCA notice, we may remove or disable access to the allegedly infringing material and notify the affected user.
Counter-Notices
If you believe material was removed or disabled by mistake or misidentification, you may submit a written counter-notice to our designated agent that includes:
- Your physical or electronic signature.
- Identification of the material that was removed or disabled and the location where it appeared before removal or disabling.
- A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, mailing address, telephone number, and email address.
- A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or if your address is outside the United States, any judicial district in which Glasstack, LLC may be found.
- A statement that you will accept service of process from the person who submitted the original DMCA notice or that person's agent.
If we receive a valid counter-notice, we may forward it to the original complaining party. Unless the complaining party notifies us that it has filed an action seeking a court order to restrain the user from engaging in infringing activity, we may restore the removed material or cease disabling access after 10 business days and no later than 14 business days after receiving the counter-notice.
Repeat Infringers
We have adopted and reasonably implement a policy that provides for the termination, in appropriate circumstances, of users who are repeat copyright infringers.
We may consider a user a repeat infringer if we receive multiple valid DMCA notices concerning material hosted, stored, transmitted, or otherwise made available through that user's account. We may suspend or terminate accounts, disable servers, remove files, or take other action where appropriate.
Misrepresentations
Any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys' fees.
No General Monitoring
We are not obligated to monitor user content. However, we may remove or disable access to content at our discretion, including content that appears to violate our Terms of Service, Acceptable Use Policy, this DMCA Policy, or applicable law.
